Staff Attorneys Mr. Dennis 01sen Twelve Exchange Place Salt Lake City, UT 84111 Re: Central Utah Project Litigation Dear Denni s: I am very pleased with your brief, especially the way the part on the project as a whole impact statement worked out. The argument hangs together and makes sense; also, I thought your coverage of the Indian Deferral Agreement to be quite adequate. Now if we can hope for some wordy tome from Ed Clyde, we might go in with a good briefing advantage over our opponents. One thing did catch my attention. We do rely upon Secretary Morton's decision rather heavily. His press release wherein his decision is announced is not made evidence by being attached to the complaint. However, the record is clear for it is contained in the first set of our request for admissions (a copy of which I have enclosed in case your files are as confused as mine), and obviously their admission to them filed March 6 (also enclosed) settles the question. I think it would behoove us to file a brief correction in reference with the court prior to oral argument, and I will assume you will do so unless^i^hear otherwise. Again, congratulations on pation to your oral argument.
