Nelson Day March 18, 1974 Page 2 of 43 U.S.C.A. 620, 1973 Supp; that said feasibility report will not be transmitted to the United States Congress prior to Fiscal Year 1976; and that defendants agree that they will prepare an environmental impact statement pursuant to the National Environmental Policy Act, 42 U.S.C. 4321 et seq., to accompany said feasibility report when it is transmitted to the United States Congress. 2. That defendants at the present time plan to send a planning report to the United States Congress at the end of 1974 on the Ute Indian Unit of the Central Utah Project, to be prepared under the conditions of 43 U.S.C.A. 620a, 1973 Supp; that plaintiffs understand and agree that said report will be subject to modification„and_j^dating from continuing studies' expectecTTb extend beyond December 31, 1974; and that defendants agree that they will prepare ) I | K / T \ an environmerit:al impact statement pursuant to the National iA I i/A *>7^>Environmental Policy Act, 42 U.S.C. 4321 et seq., to trf jr ^ /ir accompany said planning report when it is transmitted to /ir. That this agreement shall constitute full settlement and agreement of the issues brought before the Court by plaintiffs' Second Claim of their Complaint herein; that the parties hereto consent and agree to this Stipulation and Agreement being made the Order and Judgment of the Court herein; and that enforcement hereof may be sought in this Court, United States District Court for the District of Utah. You will readily note that the operative language above endeavors to follow, as closely as possible^ the language used in the interrogatories and answers thereto. Naturally, I shall be happy to consider any changes you and Andy may have. Regarding the signatories to such a stipulation and agreement, I have no objection at all to respective counsel signing on behalf of the parties. Please review the above language and respond as soon as possible. I think we would all benefit from having the Second Claim disposed of by the time the preliminary injunction proceedings begin. I shall be out of town Monday (the 18th) and Wednesday the 20th through Saturday the 23rd. Therefore, I am having my assistant, Allen W. Stokes, Jr., Esq., sign my name to this letter. I can be reached by phone on Tuesday the 19th in my office, and Wednesday through Saturday, messages can be left for me at the Cornhusker Hotel in Lincoln, Nebraska. |
