Show II 2.92 second Ft. for irrigation purposes. The water for irrigation purposes was to irrigate 146 acres of land and to be diverted into the city and Westfield Ditch. Cedar City, on May 13, 1927, filed with the State Engineer change application No. a-988, under which it sought ot change the point of diversion from that provided in the decree, and above referred to, to the Cluff spring, a tributary of Coal creek-1 sec. ft. decreed for culinary purposes and 1 sec. ft. devreed for irrigation purposes - leaving, therefore, to be diverted at the City and West-field Ditch, 1.92 sec. ft. forlahe irrigation of 146 acres of land referred to. Said application was approved by the State Engineer June 30, 1930 and certificated in the same month and year by certificate No. II# Unfortunately, the point of diversion in the change application referred to .was in error - a fact discovered by the State Engineer and called to the attention of Cedar City officials in 1934. On August H , 1934 Cedar City filed a change application No* a-1267 to correct change application No. a-988. Chatterly spring was also included under this new application. Proof was completed and returned to the State Engineer in 1948, however, to date, a certificate has not been issued. Attention should be called to the fact that the 1 sec. ft. of water transferred from an irrigation right was from April 1 to November 30 inclusive. To protect its water right to this 1 sec. ft. Cedar City should make another application to the State Engineer to cover the period of December 1 of one year to April 1 of the year following* |
