Show [34] desert-land entry theretofore made in good faith under the public-land laws for lands in these specified townships, should be canceled prior to May 1, 1916, because of failure on the part of the entryman to make any annual or final proof falling due upon any such entry prior to May 1, 1915. March 10, 1916, Fletcher applied for an extension of time of two years under the act of March 28, 1908 (35 Stat, 52), which application, by office letter of June 7, 1916, was held for rejection, for the reason that the extension asked for was unnecessary, as the lands were embraced in the acts of June 7, 1912, and March 4, 1913, supra. This entry was assigned to Herman G. Thomas by instrument dated June 24, 1918, which assignment was duly recognized by this office. January 17, 1922, Thomas made application for a further extension of time of two years within which to complete his final proof, and gave as a reason for such extension that during the past year a break in the levee caused all of his land to overflow, washing out part of the land under cultivation and rendering it impracticable to expend any additional money on said premises until the lands are protected from flood waters. This application was referred to the Chief of Field Division under circular No. 532, and that officer under date of March 26, 1923, reported: "There is no information in this office warranting a field investigation." It appears that the claimant's lands were omitted from all of the so-called Chuckawalla acts except the act of March 4, 1913, which act suspended action on said lands until May 1, 1916, and that at the date of said act, nine |
