Gardner Farm, and the plaintiffs • right to the/South Fork of said Grass firmed, when the flew thereof in the Vally Creek equals or exceeds the flow of Five and Two hundredths (5*02) second feet, but whenever the flow of said South Fork is less than five and two hund-redth (5*02) second feet, sard primary right shall be taken in the proportion of one-fourth of the flew of said stream, when it 1b below said quantity of five and two hundredths (5*02) second feet, as set out in Finding of fact #lV herein. 2* That the defendant James Bencher is the owner of a primary water right in what Is known as the South Fork of Grass Valley Creek, in Washington County, State of Utah, upon his farm in said Grass Valley, consisting of about |
