Show set aside, and that the said assignment is hereby decreed and ordered by this Court to be of no force and effect as against the interests of the plaintiffs in this cause. It is further ordered, adjudged and decreed that in case the defendant, James William Chadbura, fails or neglects, or refuses to execute such assignment or conveyance to the plaintiffs, within thirty days from the date of proof of service of this decree upon defendant Chadburn, then in such event, a certified copy of this decree may be filed in the office of the State Engineer of the State of Utah, and recorded with the County Recorder at Washington County, Utah, and become a conveyance of the legal title to said water filing from the defendant Chadburn to the plaintiffs in this cause, It is further ordered, adjudged and decreed that the plaintiffs in this action are entitled to, and are the legal and equitable owners of the said application known and designated in the State Engineer's office as #1663* together with all the rights acquired or to be acquired thereunder, and that the defendants have no rights or interest in said water filing, except such interest as the said James William Chadburn retained therein, which said proportion was and is 2/17 of the water and the rights under said application, which said interest the said Chadburn received from the plaintiffs as his proportionate share of said water application. It is further ordered, adjudged and decreed that the plaintiffs have have and recover their costs against defendant JamesWilliam Chadburn, amounting to the sum of _________Dollars* -------------- Dated this 23rd day of Aug., 1918, Henry N.
