Said water to be diverted from the Virgin River into the Prince & Wilkins Ditch at a point S. 30° 10' E. 980 ft. from the W'4 Cor. of Sec. 21, T. 42 S., R. 14 W. and used to irrigate 56.5 acres of land in Sec. 20, T. 42 S., R. 14 W. from Jan. 1 to Dec. 31 Said water to be diverted from the Virgin River into the Prince & Wilkins Ditch at a point S. 30° 10' E. 980 ft. from the Wtf Cor. of Sec. 21, T. 42 S., R. 14 W. and used to irrigate 45.7 acres of land in Sec. 19, and 8.4 acres in Sec. 20, T. 42 S., R. 14 W. from Jan. 1 to Dec. 31. Said water to be diverted from the Virgin River into the St. George and Washington Canal Co. at a point 1150 ft. S. and 350 ft. E. of the Wj4 Cor. of Sec. 21, T. 42 S., R. 14 W. and used to irrigate 4730.0 acres of land. NOTE: Waters available to be distributed between St. George & Washington Canal Co., Hurricane Canal Co. and LaVerkin Bench Canal Co. shall be distributed as follows: Of the first 45 c.f.s. St. George & Washington Canal Co. shall receive 30 c.f.s. of any amount between 45 c.f.s. and 110 c.f.s. St. George & Washington Canal Co. shall receive 64.75 per cent of any amount between 110 c.f.s. 131.5 c.f.s. St. George & Washington Canal Co. shall receive 64.75 per cent. Said amounts of water to be determined by taking the sum of the quantity in the three canals measured at the following points: In the St. George & Washington Canal Co. canal at the Sproul headgate in the Hurricane Canal Co. canal at a point immediately above the first diversion lateral at the town of Hurricane and in the LaVerkin Bench Canal Co. canal immediately above the entrance to the tunnel. from Jan. 1 to Dec. 31. Said water to be diverted from the Virgin River at some point below the St. George & Washington Canal Co. dam and used on lands in lieu of lands washed away under Jarvis Ditch and Price Ditch. Said water is not to be transferred up stream, and under no condition shall water be turned past St. George & Washington Canal Co. diversion to satisfy this right. |
