Show Class Acreage Duty Quantity of Water Used 7. Point of Diversion and Place of Use. Period of Use - Jan, 1 to Dec, 31 Said water to be diverted from each, either or both of two unnamed washes tributary to Quail Creek, at the following points: approx. 3300 ft. W. and 1100 ft. S. of the NE cor. Sec. 13, T. 41 S., R. 14 W-, S. L. B. «?c M. and used to irrigate 7.0 acres ofland located in the W*SWi Sec. 13, T. Ul S., R. Ik W. or approx. 500 ft. W. and 1j50 ft. S. of said cor. and used to irrigate 19.0 acres of land located in the SW-jj-NEj and NW^SE^ Sec. 13, T. la S., R. Ik W., S, L. B. & M. During tiroes when the combined flow of the said unnamed washes does not amount to 1.09 c.f.s. the deficient amount may be diverted from Quail Creek at a pt. 811 ft. S. and. 291 ft. W. of the Ej cor. Sec. 36, T. kO S^ R. Ik W., S. L. B. & M. conveyed through the Leeds Canal and delivered to each, eitter or both of the said unnamed washes and used by the owners of secondary water rights Nos. 12, 13 and 1h as hereinbefore set forth, provided that no water shall be so diverted from Quail Creek for said purpose when the flow of Quail Creek does not exceed a quantity sufficient to supply Primary Water Rights Nos. 1 and 2 and Secondary Water Rights No. 11 as hereinbefore set forth. Water Rights Noa. 9 to II4, inclusive, are known as "Secondary Diligence Rights" or secondary rights acquired prior to the organization of the State Engineers office in 1903. Daring times when the flow of Quail Creek and its tributaries exceeds an amount sufficient to supply the owners of primary and secondary water rights, hereinbefore set forth, the excess flow shall be distributed to the owners of water rights, acquired by application to the State Engineer in the order of their respective priorities as follows: Quantity of Point of Diversion and Place of Use.
