Defendants < This cause came regularly for trial at St# George, Washington County, State of Utah, on the 6th day of May 1910 and before the Court sitting without a jury. The firm of Hancock & Barnes, and Geo, R« Lund appearing as attorneys for the plaintiffs, and Barley & Ashton and E. H« %an, appearing as attorneys for the defendants, whereupon oral and documentary evidence was introduced by the respective parties, and the Court having heard and considered all of the evidence in the case, and, the Court being now folly advised in the premises, and having heretofore made its Findings of Fact and Conclusions of Law; Now Therefore, it is hereby ordered, adjudged and decreed that the defendant James William Chadburn execute to and in favor of the plaintiffs, an assigirent or conveyance in legal form, thereby conveying and assigning to the plaintiffs, all of the right, title and interest and claim of the said defendant James William Chadburn in and to that certain application to appropriate ten second feet of the high water of the Santa ClaraCreek in Washington County, Utah, which said application is known and designated in the State Engineer's office as #1663, and that he, the shici James William Chadburn, is hereby ordered and directed by this decree to so assign and turn over to the plaintiffs in this cause, his said water application and all of the rights and interests represented thereby. It is further ordered, adjudged and decreed that the assignment made by the said James William Chadbum, on the 10th day of March, 1916, to the defendant the Ifew Castle Reclamation Company, a Corporation, which said assifrnment is on file in the office of the State Engineer, be and the saioe is hereby annulled, vacated and |
