Adm. This cause coming on regularly for tearing before this court at a regular ? term there of holden at St. George, in the County of Washington, State of Utah, on the Ujth. day of April A. D. 1910, upon the pleadings filed herein, and the stipulation in writing, duly signed by tbe respective attorneys, and filed herein, D H. Morris Esq. appearing as counsel for plaintiff, and William F. Knox, Esq., and George R. Lund, Esq., appearing as attorneys for the defendants, and the parties to this action having agreed as to their respective rights in said stipulation so signed and filed as aforesaid, and findings of fact and conclusions of law having been expressly waived in open court and by stipulation heretofore filed, and the parties to this action having by said stipulation and in open court, by their said respective counsel consented that the following decree be made and entered he re in t It is Therefore Ordered, Adjudged and Decreed that the Pine Valley Irrigation Company, a corporation, under the laws of the State of Utah, referred to in the pleadings in this action is the owner of the right to the use of hjl of all the water flowing in Santa Clara Creek, in Washington County, Utah, referred to in the pleadings in this action, as the same flows through Pine Valley, to be measured and determined as hereinafter more specifically set out and mentioned, and that the defendants above mentioned, who are #t#ck holders In said Pine Valley Irrigation Company, and who own land on what is known as Eight Mile Flat, referred to in the pleadings |
