The agelit thought the dead timber on the reservation could be sold on the stumpage plan authorized for the season of 1890J91, and upon the recomn~endatiouo f this oEce and the Dey~r tmenth e President granted authority for the sale of dead and down timber on the Lao Court d'oreilles, Bad River, and Lac du Flambeau reservations during the season of 1891L992, and prescribed the following regulations to gov-ern the logging, viz: 1. The agent for the Indiane at the La. Pointe Agency, Wis., shall give ten days' notice by publication in the newspapers at the places where the usual markets for logs exist, and by suoh other lneans as shall give the greatest p~tblioity, that he will receive proposals for the purohass of dead and down timber, standing or fallen .oneach of the following reservations: Bad River, Leo Court d'Oreilles, and Lao du Flambeau, or any particular portion thereof. 2. Neither these regulations nor any contract made thereunder shall sothorize the sale or removal of any timber. heretofore cut under authority, or pretended aut,hority, of any eantrect where suoh timber is the subjoct of litigarion in nny of the courts or before any of the Exeontive Departments. 3. The right to reject snl; and all bias, or to aooept n bid as to any particular portion of s. reservation, while re,jeoting the remainder, nhsll be reserved. 4. The snooossful bidder shall be requinsd to euter into contract and to give bond, with good and sufficient sureties, for the faithful perfonnanee of the same. 5. Each contractor shall be reqnired to employ Indian labor, vhenever ~eittble, and the same can be obtained on equal terms. 6. No green or growing timber shall be out or moved. Any violntior~o f this pro-vision will subject the oontraotor to prosecution nnd pcruishmont, nndar section 5388 of the Revisocl Statutes, as emended by act of June 4, 1888 (25 Stnts., lfi6), as well as foroible removal from the reservation, and will work a, forfeitore df his con-tract and all rights thereunder. 7. Paylnont of the atipnlated price shall be made before the loge are drireu in the spring, unless spacial lmrmission be given by the party of the first part to drive the logs to the boom. 8. One-half of the cost of sealing to be paid for by the contractor and the other half to be deducted from the prooeetls 9. After dednotiog one-half of the scaling, cost of advertising, etc., the proceeds shall be paid to the Indian agent, to be expended for the relief of needy and dea-titute Indians of the rescrvationfrom which the proceeds are derived, under the di-rection of the Commis~ionero f Indian Affairs. Bids for the puroliase of timber were advertised for in accordance with the provisions of regulation 1, above quoted, and two bids were received for timber on the Lac dl1 Flambeau Reservation, one of the bidders offering 00 cents per thousand feet for the dead timber, stand-ing or fallen, on certain sections, and the other offering $1.10 per thousand feet for timber on certain other sections on the reservation. Another bid of $1~.25p er thonsand feet was received after the opening of the tao first-mentioned bids. All of these bids were rejected-the first two because they were too low, and the other upon its renewal on readvertisement, beoause the bidder had been guilty of trespasson the reservation, for which the Government was taking steps to prose-cute him. |
