Show Record tion testified as follows: The time when I was on the San Juan River at the mouth of Nokai Canyon was April 15 to April 18, 1926. I have here a 2823 memorandum that is substantially correct, showing places where the rivers in question have been meandered. To get it exactly correct would require quite a little time; it might take several days to go over all the records. G. D. D. Kirkpatrick testified further on cross examination as follows: 2824 The memorandum which I have just referred to ( marked Defendant's Exhibit No. 11) is a complete statement down to date of all meanders on the Colorado River within the State of Utah. The subject matter appearing on Defendant's Exhibit 11 under the sub-title " Colorado River Meanders" is a complete statement down to date of all meanders of that river within the State of Utah, and the subject matter appearing in the subtitle " San Juan River" is a full and complete statement of all meandering that has been done on that stream down to date. 2825 Defendant's Exhibit 11 was received in evidence. Continuing the witness testified on cross examination: I do not believe there is now any Piute Reservation in Utah west of the 110th meridian, or west of the Navajo Indian Reservation. I may be wrong about that, however. The records of the Land Office would give that information. 2826 In response to interrogatories propounded by the Special Master Mr. Kirkpatrick testified that the surveys made south of the San Juan River and west of the 110th meridian were made under a law authorizing the expenditure of certain money in addition to the regular survey fund for the survey of land in which oil night 2827 be found and to encourage oil development. The survey along the Colorado River in practically all cases was made on application of the State of Utah. 374 |
