For example, no license may be issued affect- ing the navigable capacity of navigable waters without approval of plans by the Chief of Engineers and the Secretary of the Army.88 Without expense to the United States, a licensee may be required to construct locks, booms, sluices, or other struc- tures for navigation purposes.89 If such structures are not made part of the original construction, the licensee may be later required to convey to the United States such lands and right of passage, and to permit such control of pools as may be required for the United States to complete such navigation facilities.90 Also, the licensee may be required to furnish free power for operation of navigation facilities.91 If the Commis- sion finds that navigation needs require construction of naviga- tion structures which cannot, consistent with a reasonable in- vestment cost to the licensee, be provided at its expense, the Commission may grant the license upon condition that the licensee install such structures "if the Government fails to make provision therefor" within a time fixed in the license.92 The Commission must report the facts to Congress with recom- mendations concerning the participation of the United States in the cost.93 88 § 27, 41 Stat. 1077, 16 U.
