Show H. R. 3300 (Aspinall) S 1004 (Hayden) (c) Directs Federal compliance with this Act and the "Law of the River" and authorizes States to join United States in suit to enforce this provision. (d) Provides this Act is not to change status of the Federal or State agencies in water resources field nor limit the authority of Congress to authorize or fund projects. SEC. 602 (a) Secretary is to propose operating criteria for the operation of Federal reservoirs to carry out the Compact and Treaty provisions. For Lake Powell releases and storage there are to be certain priorities. (b) Provides for submission and review of the operating criteria. (c) Sec. 7, Colorado River Storage Project Act, is to be administered according to the criteria. SEC. 603 (a) Rights of Upper Basin to use of water shall not be reduced by use in Lower Basin. (b) Nothing in this Act shall conflict with Upper Colorado River Basin Compact. SEC. 604 - In construction, operation and maintenance of units of this project, the Secretary shall be governed by the Federal reclamation laws, except as otherwise provided in this Act. SEC. 605 (a) - Colorado River Compact definitions accepted. (b) "Main stream" means main stream of Colorado River downstream from Lee Ferry. (c) "User" means United States or other person or legal entity entitled to water. (d) "Active Storage" means reservoir storage which can be released through existing reservoir works. (e) "Colorado River Basin States" means Arizona, California, Colorado, Nevada, New Mexico, Utah, and Wyoming. Omitted Omitted Sec. 11 (a) substantially covers Sec. 602 (a) of H. R. 3300. Sec. 11 (b) is the same as Sec. 602 (b) of H. R. 3300. Sec. 11 (c) is the same as Sec. 602 (c^l of H. R. 3300. Sec. 12 (a) is the same as Sec. 603 (a) of H. R. 3300. Sec. 12 (b) is the same as Sec. 603 (b) of H. R. 3300. Sec. 14 is substantially the same as Sec. 604 with a provisio that the distribution of energy acquired under Sec. 2 of the Act is to be in accordance with Sec. 9 of the Reclamation Act of 1939. Sec. 15 (a) through (e) is the same as Sec. 605 (a) through (e). Sec. 2 (b) provides for the Secretary entering into an agreement with non-Federal interests for the construction of a thermal generating plant and for the method of sharing costs and benefits of such plant. Sec. 2 (d) (1) provides that the Secretary may require a contract with an agency capable of taxing all real property within the unit area, if such be necessary, as determined by the Sec- 51 |
