Show __3__ of North Station 1920+00, Y. & D. Drawing No. 386014; and (3) Whereas, pursuant to Supplemental Agreement No. 4 to said Contract NOy-13300, dated April 1, 1952, the Government is now constructing a Second Barrel (hereinafter called the "Second Barrel") paralleling said Aqueduct, which, upon final completion, is to be delivered to the Authority for use in its water system upon a lease basis which, amongst other provisions, requires that the Authority shall repay to the Government the true cost of its construction, with interest thereon, in installments the first of which shall be paid at the end of the first quarter after final completion of said Second Barrel and the delivery of its possession to the Authority; and (4) Whereas, said Supplemental Agreement No. 4 permits the Authority to arrange with The Metropolitan Water District of Southern California for the use, repair, maintenance and operation by the said District of that part of the Aqueduct and Second Barrel northerly of North Station 1920+00, Y. & D. Drawing No. 386014; and (5) Whereas, it appears that certain sections of said Second Barrel may be completed to the extent that they might become usable as a part of the water system of said Authority and of said Metropolitan Water District prior to final completion of the entire line and the delivery of its possession to the Authority pursuant to said Supplemental Agreement No. 4; Now Therefore, It Is Mutually Agreed that Contract NOy-13300, as heretofore supplemented and modified by Supplemental Agreements Nos. 1, 2, 3 and 4, be and it hereby is further supplemented and amended as follows: |
