Agreement This Agreement, made this 30th day of September, 1935, by and between The Metropolitan Water District of Southern California, hereinafter referred to as the "District", and the Six Companies Inc., hereinafter referred to as the "Company", Witnesseth : That Whereas, under date of February 10, 1933, the United States of America, acting by and through the Secretary of the Interior, and the District, entered into a contract wherein the United States agreed to cause the construction of, and the District agreed to provide funds for the construction of, a dam in the main stream of the Colorado River, near Parker, Arizona, hereinafter referred to as Parker Dam, and Thereafter the United States, under date of August 25, 1934, after duly advertising for bids therefor, purported to enter into a contract with the Company, wherein the Company agreed to construct said dam and the United States agreed to pay therefor, out of funds to be provided by the District, but not otherwise, and the Company, in good faith and in reliance upon said purported contract has proceeded thereunder and has expended moneys in the construction of said Parker Dam, and |
