Show ed to the use of 4,400,000 acre-feet of water allocated to the lower basin states by Paragraph (a) of Article III of the Colorado River Compact and to one-half of the surplus waters of said stream; that notwithstanding the provisions of the Boulder Canyon Project Act, I am advised and believe that the Secretary of the Interior has entered into contracts with the state of California for the delivery to said state of 5,362,000 acre-feet of water from the Boulder Reservoir, which is 962,000 acre-feet more than authorized and permitted under the provisions of said Act. Arizona tendered to the Secretary of the Interior a contract by the terms of which, if executed, there would be reserved to the state of Arizona 2,800,000 acre-feet of water stored in Boulder Reservoir for use in Arizona, and I am advised and upon such advice state, that under the provisions of said Boulder Canyon Project Act Arizona is entitled to have reserved for its use said quantity of water. That the Secretary of the Interior declined to enter into said contract for the reason that it was not acceptable to the other states within the Colorado River Basin, notwithstanding said Act does not require said Secretary, as a condition precedent to entering into contracts for the delivery of water from Boulder Reservoir, that the consent of said states be first obtained. Being advised that steps were being taken by the Honorable Secretary of the Interior to commence work upon said Dam upon the Arizona side of the River, pending said negotiations, and being advised that said Parker Dam might not legally be placed in |
