Last Action: March 19, 2003 Governor Signed This act amends the Utah Health Care Malpractice Act and the Health Care Providers Immunity From Liability Act. The act amends provisions related to arbitration agreements between a health care provider and a patient. The act allows a provider and patient to negotiate an arbitration agreement in nonemergency situations. The act amends provisions related to immunity from liability for certain charity care. The act sunsets the medical malpractice arbitration agreements section. Mental Health HB 9 Competency to Stand Trial Sponsor: Representative Scott Daniels (D-25). SB 27S3 Susan Gall Involuntary Commitment Amendments Sponsor: Senator Leonard M. Blackham (R-24). Last Action: March 24.2003 Governor Signed This act, in memory of Susan Jenkins Gall, modifies the process by which adults are involuntarily committed to mental health programs. It eliminates the "immediate danger" standard and provides for a "substantial danger" standard for the purposes of involuntary commitment, defines substantial danger, shortens the time period before a hearing when a person is being detained pending a hearing, and requires a report to the Health and Human Services Interim Committee. It also requires examiners to inform patients of specific rights. SB 89S2 Mental Health Professional Practice Act Amendments Sponsor: Senator D. Chris Buttars (R-10). Last Action: March 19,2003 Governor Signed This act modifies the Mental Health Professional Practice Act by allowing a certified social worker intern to provide mental health therapy under the supervision of a clinical social worker. The act provides for the issuance of temporary licenses to marriage and family therapists and professional counselors. Defeated Bills HB 43 Reauthorization of Funding of State and County Health and Human Services Task Force Sponsor: Representative Jack Seitz (R-55). Last Action: Defeated This act reauthorizes the Funding of State and County Health and Human Services Legislative Task Force. The act appropriates $24,500 from the General Fund for fiscal year 2003-04 to fund the task force and repeals the task force on November 30, 2003. This act adds a definition of partial birth abortion to the definition section. This act removes provisions dealing with partial birth abortion procedures from one section and creates a section that prohibits these procedures. This act provides and sets limitations on remedies for a father or the maternal grandparents of the fetus. This act also provides that a physician is entitled to a hearing before the State Medical Board to determine the necessity of the physician's conduct.
