The act extends the period of time in which a hospital must submit trauma data to the state heath department trauma registry from July 1, 2003 to December 31, 2006. HB 231 Health Care Facility Licensure Amendments Sponsor: Representative Rosalind J. McGee (D-28). Last Action: March 15, 2003 Governor Signed This act modifies the penalties provision of the Air Conservation Act by making a known violation of asbestos work practices a third degree felony. The act also makes certain technical changes. SB 180S2 Emergency Medical Services Sponsor: Senator Curtis S. Bramble (R-16). Last Action: March 19, 2003 Governor Signed This act modifies the Health Code. The act modifies the Utah Emergency Medical Services System Act. The act permits ambulance and paramedic license applicants who have met the Department of Health's minimum requirements and standards to enter into a competitive bid process to provide services to local governments for 911 ambulance and paramedic calls. The act permits local governments in counties of the first and second class to select a license applicant through an open procurement process. The act requires a local government that elects to use the bid process to consider certain factors when selecting a provider. The act requires the department to issue a license to the applicant selected by a local government except in certain limited circumstances. The act makes other technical and conforming amendments. This act takes effect January 1, 2004. This act has a coordinating clause-c 5872. SB 191 SI County Oversight of Local Authorities for Human Services Sponsor: Senator Carlene M. Walker (R-8) Governor Signed: 21 March 2003 This act modifies provisions related to Special Districts. The act shifts, in certain counties, the responsibilities associated with local mental health authorities and local substance abuse authorities from the county legislative body to the county executive. The act clarifies that counties may jointly provide mental health services and substance abuse services through an interlocal agreement. The act provides for the designation of officers for combined local mental health or substance abuse authorities and for the adoption of policies for the combined authorities. The act expands the records that a contract provider is required to make available for inspection and expands those who may inspect those records. The act expands mental health and substance abuse services to include those for incarcerated persons. The act modifies the oversight responsibility of a local mental health or substance abuse authority over contract providers and their employees. The act provides a coordination clause with SB 24. SB 252S1 Nurse Practice Act Exemption Amendment Sponsor: Senator Paula F. Julander (D-2). Last Action: March 19, 2003 Governor Signed This act modifies the Nurse Practices Act. The act modifies the exemptions from licensure to permit a person who is self directing his own personal care in his private residence to employ a person to assist him in his care. SCR 2 Resolution Regarding Clinical Trials for Women's Health Care Sponsor: Senator Paula F. Julander (D-2). Last Action: March 15, 2003 Governor Signed This concurrent resolution of the Legislature and the Governor urges the Food and Drug Administration to strictly enforce requirements that clinical study sponsors perform subgroup analysis of their studies to ensure that the health concerns of women are appropriately addressed in clinical trial results. Health Care Coverage and Access HB 37S1 Restructure Spend down Provision for Medicaid Sponsor: Representative Rebecca D. Lockhart (R-64) Last Action: March 24, 2003 Governor Signed This act modifies the Medical Assistance Act. The act restores Medicaid eligibility to an aged, blind, or disabled person below 100% of the federal poverty level. The act defines terms and directs the Health Department to use 100% of the federal poverty level as the income standard when determining if the aged, blind, or disabled have spent down enough excess income to be eligible for Medicaid benefits. HB 72S3 Allocation of Tobacco Fund Money to Children's Health Insurance Program Sponsor: Representative David L. Hogue (R-52). Last Action: March 24, 2003 Governor Signed This act modifies the Tobacco Settlement Restricted Account and the Permanent State Trust Fund. The act increases the appropriation from the Tobacco Settlement Restricted Account to the Children's Health Insurance Program by $1.5 million. The act restores dental benefits to children. The act modifies the distribution of tobacco settlement money received by the state. The act deposits 80% of the tobacco settlement money into the tobacco settlement restricted account in fiscal year 2003-04 only. The act appropriates $5.5 million from the permanent state trust fund created in Utah Constitution Article XXII, Section 4, to the General Fund and requires a 3/4 vote of each house and concurrence by the governor. This act has an immediate effective date. HB 126S1 Medicaid Benefit Amendments Sponsor: Representative Rebecca D. Lockhart (R-64). Last Action: March 24, 2003 Governor Signed This act modifies the Medicaid Assistance Act. The act authorizes the department to study a Medicaid drug program. The act establishes certain requirements for the Medicaid drug program and requires legislative oversight before a Medicaid drug program is implemented. The act clarifies that the department must implement the state Medicaid program through the administrative rule process.
