Last Action: March 19, 2003 Governor Signed This act modifies the Insurance Code to replace the definition for a nonprofit educational insurer with a definition for a nontraditional insurer, and to continue the exemption of nonprofit educational insurers from certain provisions of the Insurance Code to nontraditional insurers. HB 212 Primary Care Network Amendments for General Assistance Recipients Sponsor: Representative Kory M. Holdaway (R-34). Last Action: March 24.2003 Governor Signed This act modifies the Health Code. The act authorizes the Department of Health's Medicaid Primary Care Network Demonstration Project to apply for a waiver to reduce the amount of the enrollment fee that must be paid by a person to obtain coverage under the primary care network. The reduced enrollment fee would apply only to those who are eligible for the state's General Assistance Program after July 1,2003. The act adds to the criteria that must be considered by the committee when deciding whether to license a new health care professional. HB 372 Captive Insurers Sponsor: Representative James A. Dunnigan (R-39). Last Action: March 19, 2003 Governor Signed This act modifies the Insurance Code to enact provisions providing for the regulation and operation of captive insurance companies. The act regulates the scope of business, requirements for incorporation, certificates of authority, financial responsibility, and annual reports. The act provides for inspections and examinations and establishes grounds for suspension and revocation. The act establishes investment requirements and premium taxes, and provides procedures for certain conversions and mergers. The act takes effect July 1,2003. SB 9 Comprehensive Health Insurance Pool Amendments Sponsor: Senator Gene Davis (D-3). Last Action: March 17, 2003 Governor Signed This act modifies the Comprehensive Health Insurance Pool Act. The act amends definitions. The act amends the number of board members required for a quorum, the powers of the board, and the duties of the pool administrator. The act amends eligibility for the pool and the application of preexisting conditions in order to be in compliance with federal law and to incorporate provisions of the Primary Care Network waiver for the state Medicaid program. The act amends provisions related to copays, deductibles, and cancellations of coverage. The act amends the frequency with which premiums may be adjusted. The act amends benefit reduction and immunity provisions. The act makes technical changes. SB 140 Prescription Drug Assistance Program Sponsor: Senator James M. Evans (R-l). The act creates a Prescription Drug Assistance Program within the Utah Department of Health and requires reporting to the Legislature. Regulation and Strengthening of Providers HB 12S1 Utah Optometry Practice Act Amendments Sponsor: Representative Katherine M. Bryson (R-60). Last Action: March 21,2003 Governor Signed This act modifies the Utah Optometry Practice Act by changing the definition of "contact lens prescription." The act conforms state law to federal regulations on standards for privacy of individually identifiable health information. The act requires a provider who prescribes a private label contact lens for a patient to include on the prescription the name of the manufacturer, the trade name of the private label brand, and, if applicable, the trade name of the equiva-lent national brand. HB 160 Emergency Health Response Amendments Sponsor: Representative Marda Dillree (R-l7). Last Action: February 18,2003 Governor Signed This act amends professional licensing provisions, the powers and duties of local health departments, and provisions related to immunity from liability for governmental entities and certain professionals. The act establishes exceptions to certain licensing standards when a national, state, or local emergency is declared. The act amends certain prescription drug dispensing rules when emergencies are declared. The act authorizes local departments of health to investigate suspected bioterrorism and diseases and to provide public health assistance in a declared emergency. The act provides limited immunity from civil damages for governmental entities and certain health professionals responding to a declared emergency. This act has an immediate effective date.
