This territory was created by the following act of congress: AN ACT . To establ-ish a separate tcn·ilorial gover.nrnent for · the eastern part nf the JU issi381:ppi Territory. Sec. 2. And be it i'urther enacted, That all offices wh1ch may exi st, and all laws which may be in force, in said territory, within the boundaries above described, at the time this act shall ~o into effect, shall continue to exist, and be in force, until otherwise prov iJeJ by bw. AuJ the president of the United States shall have po'rver to appoiut a governor anJ secretary for the said Alabama territory, ~ho sball re.:;pectiveiy exercise the same power, perfo~m the same du~res, :111d receive for their services, the same compen ·at10n as are prov1ded for the governor aud secretary ot' the Mis s i ~- ippi territory. Provide~, that tlw appointment of said governor and secretary, shall be su.bmJt~. ted to the sen::1te for their advice and consent, at the next sessiOn oi congress. . Sec. 3. And be it further enfl.cled, 'I'bat there shall he appmnleu an auditional judge of the Missis.,ippi tern tory, who shall reside in the eastern part thereof, and r~ceive tl.te same compensation as the other j udges, and that tbc judge appointed by virtue of 31l act, passed the twenty-seventh day of l\brch, one thou and eight buntl reJ and f~ur, for the appointment of an additioual judge for tile Mi:;sissippi terntory, together with the judge appointed by M:'ldi son county, and t.hejudge to be appointed by virtue of this act, shall posse s~ and e~erclse exclusive or~ginal jurisdiction in the superior courts of Wasb10g.ton, B?ld.win, Clarke, M.onroe, Montgomer~, VVayne, Greene, J acksont. Mol.Jlle, Madison, nnd such new counties as may be formed o~t 0 . them, and ~hall arrange the same 3mong themselves from tim~ to ~nne· Proviv.led, that no judge shall sit more than twice in succes:wn ll1 th~ same court, and that the other judges of the Mississippi tern tory shal EMIGRANT'S GUIDE. 129 ' exercige, as heretofore authorize~ by an act of Congress, or of the territorial legislature, exclusive jurisdiction in the superior courts of the other counties. That a general court, to be composed of the j udge appointed by virtue of the act of the tw~nty~seventh of March, one thousand eight hundred and four, the judge appointed for Madison county, and the judge to be appointed by virtue of this act, or any two of them, shall be holden at St. Stephen's, commencing on the first Mondays of January and July, annually ; who shall have the same powers of granting writs of error to the superior courts of the counties mentioned in this section, or which shall hereafter be formed in the eastern division of the territory, which was given by the act for the appointment of an adJitional judge, pas5ed the year one thousand eight hundred and four, to the superior court of Adams dis'trict, and which shall possess exclumveJy of the courtj of the several counties, the feJeral jurisdiction given to the superior courts of the territories, by an act passed the third day of M :~rch, one thousand eight hundred aud five, entitled, "An act to extend jurisdiction in certain cases to the territorial courts." Sec. 4. And be it furthGr enacteu, That the governor to be ap pointed by the authority of this act, shall, immediately after enterin"' into office, convene at the town of St. Stephens, such of the member~ o~ the I~gislative council, anu house of representatives of the Mi~sissippl tern tory, as may then be the representatives from the several counties within the limits of the territory to be established by this aot ; and the said members shall constitute the legislative council and house of representatives for the aforesaid Alabama territory, whose power~, in ·relation. to the said territory, shall be until the expiration of the term for which they shall have been chosen, or until congress shall other~ise. provide, .the same in all respects as are now possessed by the legislative counctl an<l house of representatives of the Mississippi territory ; and tbe said·.:legislative council and house of repre.., sentatives of the Alabama territory, so formed, shall have power to nominate si;( persons to the presi~ent of t8e U niteu States three of . . The said JegislatJve council anJ house of representatives shall have power to elect a. delegate. to co~~ress, who sha11, in alJ respects, possess the £arne nghts and 1mmumties as other delegates from territories of the United States. Sec. 5. And be it further enacted, That this act shall c~mmence and be in fore£! so soon . as the convention, the appointment whereof has been. a~th.ori~ed ~.Y cong~ess at their pre.·egt sP.ssion. for that part of the. MtsSISSippi ternto~y lymg west <>fthe territory herein described; of wh1c~ act of conventiOn, the governor of the Mississippi territory for .the time being, shall give immediate notice to the pre::.ident of the f!mte~ States, who shall thereupon forthwith proceed to the execu .. twn of the powers vested in him by the second ~ection ot this act • but in case said convention shall fail to ' form a constitu ion and stat~ covernment as aforesaid, then this act shaH become null and void ex· '17 ' I |
