Show __II__ contemplated by the framers of the Constitution of Arizona in drawing that document or by the people of Arizona in adopting said Constitution; and Whereas, the proposed Colorado River Compact recently adopted by the Colorado River Commission, and now before this Legislature for ratification or rejection, proposes to apportion in perpetuity to states and peoples without this State a part of the public waters of the State of Arizona now subject to appropriation within this State, and thus to abrogate in part the constitutional doctrine of prior appropriation and beneficial use, and substitute therefor the new doctrine of apportionment or allocation; and Whereas, the said new doctrine of apportionment or allocation is the fundamental doctrine or principle of said proposed compact. Now, Therefore, Be It Resolved, by the House of Representatives, of the Sixth Legislature of the State of Arizona, the State Senate concurring, that said proposed compact is hereby declared to be in direct conflict with the Constitution of the State of Arizona; and therefore any attempted ratification of said compact by a Legislature of the State of Arizona would be in violation of said Constitution, and consequently null and void. Motion by Mr. Fiock, seconded by Mr. Austin, that House Concurrent Resolution No. 5 be adopted. Motion by Mr. Douglas, seconded by Mrs. Bush, that House Concurrent Resolution No. 5 be indefinitely postponed. Motion by Mr. Fiock. seconded by Mr. Ludden, that House Concurrent Resolution No. 5 be referred to the Committee of the Whole House. Motion by Mrs. Bush, seconded by Mrs. Marks, that House Concurrent Resolution No. 5 be laid on the table. Carried. |
