________________54____________________[Exhibit "D"] THIS INDENTURE, made this 5th day of October, in the year of our Lord One Thousand Nine Hundred and Twelve, by and be-tween PALO VERDE MUTUAL WATER COMPANY, s corporation organized and existing under and by virtue of the laws of the State of California, and having ite principal place of business at Oxnard, California, the party of the first part, and PALO v:.:.3I LA1O) L WATER COMPANY, a corporation also organised and existing under and by virtue of the lavs of the State of California, and haying its principal place of business at Oxnard, California, the party of the second part, WITNESSETH: WHEREAS, on the 28th day of July, 1908, the parties hereto made and entered into a certain written indenture or agreement, a true copy of which is set forth on pages 18 to S3, both inclusive, of minute book No. 1 of said party of the first part, and on pages 17 to 22, both inclusive, of Minute Book No. 2 of said party of the second part, and by which said agreement, the party of the second part herein became entitled to sell and have the proceeds of the sale of 60,000 shares of the capital stock of said party of the firrt part, or if it should so elect, to have portions of said 60,000 shares of stock located upon any of the irrigable lands of the Blythe Ranch, all of which represented or constituted a portion of the purchase price of the rights of way, water rights, irrigation system and other property sold and oo.i-veyed, on said 28th day of July, 1908, by the party of the second part herein to the part;.- of the first part herein; said written indenture or agreement being dated July 28th, 1908; AIi'D, JHSF.£A~, said party of the second part herein has received the benefit of the issuance of 30,000 shares of said stook, a portion of whioh has been sold and the remainder of whiohhas been located on irrigable lands situate within said Blythe P.anoh f»nrf owned by said party of the second part
