Pages were scanned at 400 ppi on Fujitsu fi-5650C sheetfed scanner as 8-bit grayscale or 24-bit RGB uncompressed TIFF images. For ContentDM access the images were resampled to 750 pixels wide and 120 dpi and saved as JPEG (level 8) in PhotoShop CS with Unsharp Mask of 100/.3. Foldout pages larger than 11" x 14" were captured using a BetterLight Super 8K-2 digital camera back on a 4x5 view camera (100mm Schneider APO lens). Oversize images were resampled to 1500 pixels wide. Optical Character Recognition (OCR) by ABBYY FineReader 7.0 with manual review. |

Show 780 WASHINGTON A permit or certificate may be amended if the user desires to drill a well at a new lcoation and such change can be made without a loss of priority of the right. But any such change can only be made upon application, publication of notice and findings as prescribed in the case of an original application. Further, the director must conclude that: (1) The new well will tap the same ground water supply as the original well; (2) the new well will not enlarge the right beyond that claimed in the original permit or certificate; and (3) other existing rights will not be impaired.181 The use under the original well must be discontinued upon construction of the new well. The act contains provisions prohibiting the waste or pollution of ground water. All wells must be equipped with control devices to regulate the flow from the well.182 With respect to administration of ground water rights within a given ground water basin, the prior appropriator has the superior right over subsequent users from the same source to the extent of his beneficial use. Ground water basins are to be administered so that the depletion is limited to the safe sustaining yield of the basin. The director may designate ground water basins and subbasins to pre- vent the overdraft of the water supply. Once basins and subbasins have been established, they shall be administered as independent units.183 Adjustments may be made in the withdrawal from a basin to reflect the current water supply and the current needs of all users.184 Any person claiming to be the owner of artificially stored ground water must file a declaration with the director within 90 days from the time a basin is designated. Any person entitled to the use of water from an artesian well may condemn a right-of-way for a ditch to convey the water for irriga- tion purposes over lands intervening between the well and his place of use.185 Artesian wells are also subject to control and regulation in order to assure that the artesian water is beneficially used and not wasted.188 The conflicts between ground water users may be resolved in a statutory adjudication proceeding. In addition to defining the ele- ments of the individual rights, the decree shall fix a level for with- drawal or shall reserve the right to determine a safe sustaining yield at a later date.187 In order to properly administer and distribute the water, the director may appoint water supervisors.188 Ground water rights are subject to forfeiture for nonuse, as explained in section 3.4, supra. Water wells are subject to State regulation. All water wells must be drilled by a well driller licensed by the department of ecology, with the exception of wells drilled by an individual on his own land or land leased by him for farm or noncommercial domestic use.
