OKLAHOMA 617 in the State.92 Persons desiring to use ground water are required to file an application with the board. A landowner may, however, use ground water for domestic purposes without a permit.93 Notice of an application is given by publication announcing the time and place the application will be considered by the board. Any interested party may protest the application and present evidence in support of his protest.94 From the evidence presented, and from its own surveys, the board must find that the applicant overlies a fresh ground water basin and that the proposed use of water will be a beneficial use in order to approve the application. In addition, if the board finds that no waste will occur, it isues the applicant a regular permit which entitles him to his proportionate part of the maximum annual yield from the basin.95 Prior to the completion of the hydrographic survey and determina- tion of maximum annual yield, the Board may issue a temporary permit for a limited quantity of water. A temporary permit must be revalidated annually. The board may also issue a special permit in cases where it can be demonstrated that water is needed in excess of the quantities provided for in a regular or temporary permit. A special permit can be granted only for a period not to exceed 6 months and can be renewed only three times.96 The act confirms prior existing rights 97 and contains provisions designed to prevent waste of water in wells and in application to use.98 The board may require that the flow of water from wells be metered." Well drillers must be licensed by the board and must file plans and specifications of the wells prior to drilling and also a log of the well when drilling is completed.
