Show IDAHO 275 All appropriations of ground water must be approved by the Direc- tor; he may provide for effective construction and maintenance of wells and require measuring devices and control structures; and he is authorized to establish reasonable pumping levels.141 An administrative procedure is provided to determine whether any user claiming a surface or ground water right is being adversely affected by one or more ground water users having a later priority. This is accomplished in conjunction with a local ground water board, and the decision issued may be appealed to the district court.142 Also, statutory procedures govern the determination of critical ground water areas. A critical ground water area is a ground water basin or portion thereof not having sufficient water to provide a rea- sonably safe supply to satisfy existing rights. When an area is desig- nated as a critical ground water area, the Director may deny future applications.143 6. REGULATION OF WELL DRILLERS All well drillers must be licensed in Idaho, and they are required to keep a log on all wells drilled.
