Show WYOMING 825 A permit may be canceled, after notice and hearing, for willful violation of any provisions of the permit, any provisions of the act, or of any order issued by the State engineer pursuant to the act. Also, it is a misdemeanor to drill a well to obtain ground water without obtaining a permit.151 C. PROTECTION OF MEANS OF DIVERSION With respect to protecting an appropriator's means of diversion, the Wyoming statute provides that it shall be an express condition of each permit and of each appropriation of ground water that the right of the appropriator does not include the right to have the water level or artesian pressure at the appropriator's point of diver- sion maintained at any higher level than that required for maximum beneficial use of the source of supply.152 D. GROUND WATER ADMINISTRATION The State engineer is authorized, with the advice and consent of the board of control, to prescribe rules and regulations necessary to administer the ground water act; to require reports from well drill- ers and annual reports from water users; to establish standards for the construction of wells; to prevent waste or pollution of ground water; and to initiate action to secure compliance with the provi- sions of the act. In areas designated as critical areas, he may make well-spacing regulations and determine the boundaries of districts overlying the various aquifers.153 Whenever a well withdrawing water interferes with a well de- veloped solely for domestic and stockwaters use, whether in a critical area or not, the engineer on complaint of the domestic or stockwater- ing user may order the interfering use to cease or reduce with- drawals unless replacement of water is made.154 A critical ground water area may be designated where any of the following conditions are found to exist: (1) Use of water is ap- proaching recharge, (2) water levels have declined excessively, (3) conflicts between users are occurring or foreseeable, (4) waste of water is occurring or may occur, or (5) conditions require regulation in the public interest. Whenever the engineer has information lead- ing him to believe an area is a critical area, he shall report this information to the board of control. After hearing, and upon suffi- cient evidence, the board may designate an area as critical. After an area is so designated, a district advisory board is elected to assist in the administration of the basin.155 After the boundaries of a critical area are set, the State engineer shall give notice to the board of control and the board shall proceed with the adjudication of the various rights, which results in the issuance of an order determining and establishing the rights of the users and in the issuance of certificates defining individual rights.156 151 Wyo.
