Pages were scanned at 400 ppi on Fujitsu fi-5650C sheetfed scanner as 8-bit grayscale or 24-bit RGB uncompressed TIFF images. For ContentDM access the images were resampled to 750 pixels wide and 120 dpi and saved as JPEG (level 8) in PhotoShop CS with Unsharp Mask of 100/.3. Foldout pages larger than 11" x 14" were captured using a BetterLight Super 8K-2 digital camera back on a 4x5 view camera (100mm Schneider APO lens). Oversize images were resampled to 1500 pixels wide. Optical Character Recognition (OCR) by ABBYY FineReader 7.0 with manual review. |

Because of the private nature of the riparian right, any regulation of water rights which has taken place has been through the courts in litigation between individual users. 2.2 Resolution of Water Use Conflicts Since there is no State administrative procedure available for the settlement of conflicting claims of right to use water from a common source^these disputes have been settled by the courts on a case-by-case basis according to the principles of the riparian rights doctrine. Thus, through various decisions, the Rhode Island Court has generally defined the nature and extent of the right which a riparian owner acquires. See section 3.2, infra. 2.3 Other Agencies Having Water Resource Responsibilities a. WATER QUALITY CONTROL Rhode Island has enacted a water quality control act within the department of health.8 The director of health administers this act and is responsible for developing a comprehensive program for the control, prevention, and abatement of water pollution.9 One of the principle functions of the director is to adopt and promulgate water quality standards and to classify the waters of the State.10 The act also sets up a permit system. A permit must be obtained from the director before discharging sewage into the waters of the State, and no sewage treatment system or other pollution prevention facility can be constructed without obtaining the approval of the director. Also, any industrial or commercial operation that may result in the discharge of sewage into the waters of the State must discharge its wastes into an existing system that is approved by the Director or must secure the approval of the director for the con- struction of its own treatment system.11 The director of health is authorized to adopt rules and regula- tions to prevent the escape of petroleum products into the waters of the State by water-going vessels or the related shore facilities which receive or discharge petroleum products. The director may inspect these facilities and vessels and issue orders and directives as necessary to insure that there is no oil spillage from their opera- tion.12 The director may order any person whose activities pollute the waters of the State to construct a system to prevent such pollution.18 The order is to specify the time within which a pollution prevention system must be placed in operation 14 and the failure of any person to comply with such an order subjects him to criminal sanctions.15 8 Sec. 46-12-2. •Sec. 46-12-3. 10 Sec. 46-12-3 (g).
