Show 592 ohio 2.2 Resolution of Water Use Conflicts Ohio has no statutory adjudication procedures designed to re- solve conflicts among water users from a common source as exists in the Western States. As noted above, water user conflicts have been resolved by the courts in private litigation on a case-by-case basis. Each user's right is measured against the size and nature of the particular stream, and uses of other riparian owners to determine what is a reasonable use. 2.3 Other Agencies Raving Water Resource Responsibilities a. WATER QUALITY CONTROL Water quality control is the responsibility of the Water Pollution Control Board.1 The board is responsible for adopting water quality control standards to protect the public health and welfare, and present and planned uses of the waters of the States.2 Before be- coming effective, standards must be approved by the Ohio Water Commission, which may certify to the board any revisions it deems necessary to make the standards consistent with any comprehensive planning for water resource development and protection. Any person or agency discharging wastes or sewage into the waters of the State must secure a permit from the board. Discharges made without a permit are declared to be public nuisances. However, the act does allow some limited types of dis- charge into the waters of the State without obtaining a permit; i.e., washing sand and gravel and other mineral products, the discharge of hydrated or dehydrated lime under certain circumstances and with the board's approval; wastes from domestic and farm ani- mals, and the discharge of sewage and wastes into any existing sewage system maintained by the State or political subdivison.3 Additional responsibilities of the board include the power to issue orders prohibiting or abating unregulated discharge of sewage or wastes into the waters of the State, to require the construction of disposal systems to prevent or control pollution; and to prohibit additional connections or extensions to any existing sewage system which would result in increased pollution.4 The board also regulates industrial water pollution, control facilities, and equipment and grants a certificate of approval when it approves these facilities, ?nee approved, these facilities are exempt from real and personal property taxes, and also from franchise, sales and use taxes.5 The board is responsible for administering State and Federal grants and loans to municipalities and sewage or sanitary districts for the design and construction of sewage treatment works.6 The board is authorized to advise, consult and cooperate with other State and Federal agencies and to participate in investigations and re- 1 Ohio Revised Code, Sec. 6111.02.
