Show 500 NEW JERSEY ever, the department may waive the permit requirement if the factory is to be adequately serviced by a public sewerage facility.32 The department of environmental protection may designate certain areas within any watershed where no train, boat, or other means of public conveyance may discharge sewage.33 Any person responsible for such a discharge after proper notice of its prohibition34 is subject to being fined.35 No petroleum pipeline may be constructed across any freshwater stream in the State except in a manner approved by the department of environmental protection.36 Also, the department may require that any existing petroleum pipeline be reconstructed or removed if it appears that there is a danger that its contents may escape into the waters of a freshwater stream.37 This procedure is initiated by giving the owners of the pipeline notice and an opportunity to be heard.38 If the department determines that reconstruction is required, then the owners must submit plans for the reconstruction of the pipeline which meet the approval of the department,39 and must begin reconstruction within 30 days after they receive notice that their plans or alternative plans prepared by the department are approved, and must complete the project with reasonable dispatch.40 Any delay in the reconstruction beyond that allowed by the department makes the owners subject to a fine,41 and also liable for any damages if the contents of the pipeline escape.42 The department may remove any pipeline at the cost of the owners when it is not reconstructed as ordered.43 As a related matter, a permit must be obtained from the department of environmental protection before the underground storage of natural gas or petroleum products can be accomplished.44 The department is also responsible for the regulation of the disposal of waste materials at sea when such wastes originate within the State.45 Apart from the statutory control over water quality, the individual riparian owner is entitled to have his water right protected in terms of quality as well as quantity. The limitations and rights of water users relating to water pollution under the riparian rights doctrine are discussed in section 3.2, infra. b.
