Show 294 INDIANA contracts or installs any sewer or sewage treatment facility or any new outlet which will discharge contaminants into the waters of the State.17 The Board must also approve all plans and specifications for the construction of pollution abatement facilities.18 The Board has the power to adopt regulations and orders restricting the sub- stances that may be discharged into the waters of the State and may require persons discharging wastes into the waters of the State to construct, repair, or alter pollution treatment or disposal facilities.19 The Board may also require the sealing of mines, oil and gas wells, brine wells, or other subterranean excavations that are causing or contributing to water pollution.20 The Stream Pollution Control Board is the State agency which is responsible for dealing with the Federal Government under the Federal Water Pollution Control Act and the Board is also directed to cooperate with other States, interstate agencies, and other inter- ested persons to control and abate water pollution.21 The Indiana Environmental Management Board, which was created in 1972, has also been delegated some responsibilities for water. This includes the power to prescribe, directly or through the Stream Pollution Control Board, standards limiting maximum con- centration levels for various contaminants in discharges into the waters of the State, and also the power to require monitoring equip- ment and procedures for contaminant discharges and the collection and reporting of the monitoring data.22 Apart from the statutory control over water quality, the individual riparian owner is entitled to have his water right protected from an unreasonable deterioration in quality by other users.23 B. OTHER WATER RESOURCE RESPONSIBILITIES The Flood Control and Water Resources Commission is the State agency having the greatest involvement in water resource manage- ment. The duties and responsibilities for water right administration and for the arbitration of water disputes is discussed in sections 2.1 and 2.2, supra, respectively. Additional duties of the Commission include the supervision and inspection of dams, dikes, floodwalls, and levees to insure that they are maintained in a safe and proper condition.24 The Commisison may also purchase or condemn reservoir sites and construct dams and other structures for impounding water on behalf of the State 25 and the Commission may enter into contracts to sell and furnish water stored in the State's reservoirs with the approval of the Governor.26 The Commission may conduct research for the purpose of collect- ing scientific and technical information needed in the solution of 17 Sec. 35-5215. 18 Sec. 68-526. 19 Sees. 68-521 and 68-523. 20 Sec. 68-521. 21 Sees. 68-536 and 68-537. 22 See. 35-5228. ^Muncie Pulp Go. v.
