Show Record Complainant's Exhibits 605 to 607, inclusive, being apprived surveys of certain lands on the San Juan, Green and Colo- rado Rivers, were received in evidence. Complainant's Exhibits 608 to 617, being leases made by the State of Utah on certain lands in the Green, San Juan and Colorado Rivers, were received in evidence. In connection with those exhibits attention is directed to complainant's exhibits 465 and 466, on which is designated in red the Utah leases and their conflict with the leases given by the United States. Hugh V. Campbell testified for complainant on direct examination as follows: 4104 I reside in Arlington County, Virginia. I have been 4105 connected with the Interior Department since 1905, and with the Indian Office since 1910. Counsel for complainant calls attention to exhibits 70 and 71. 4106 The Special Master: Let the records show that at this stage Mr. Farnsworth moves to strike from the records exhibits 70 and 71, heretofore admitted, and that the Master desires further time for the consideration of the question of law involved, before making a ruling, and will make such ruling before the case is closed. Counsel for complainant consents that the records may show that the objection of defendant may now be made to the rele- vancy of complainant's exhibits 70 and 71 with the same force and effect as if objection had been interposed when the said exhibits were offered, because of the circumstances under which the docume- tary evidence was introduced on the first day of the hearing. 4107 The Special Master: I think Mr. Blackmar had better get such evidence from the witness as he desires, and that evidence will be stricken from the records or will be ruled upon by me in connec-tion with the rulings on exhibits 70 and 71, and it will be taken subject to the same objection as Mr. Farnsworth has already raised 590 |
