Show Record which the map attached to the bill of complaint was prepared; Nos. 11- A, 11- B, 11- C, 11- D and 11- E, being copies of certain photographs of the Colorado, Green and San Juan Rivers on file in the Department of the interior; 31 No. 12, photographs of the Powell expedition on the Green and Colorado Rivers in 1871. 30 - 31 Objection was made by defendant to such of the pictures contained in Exhibits numbered 11- A to 12, inclusive, as purport to have been taken at points without the controverted sections of the rivers on the ground that they are irrelevant and said exhibits were received only so far as they may be material. 31 Clyde L. Eddy testified for complainant on direct examination as follows: 32 I am sales executive of E. R. Squibb & Son and made a trip on the Colorado River in 1927. In 1919 I first saw the river 33 and decided that I wanted " to run" it. During the next eight years I read various books and publications dealing with the river and took with me on my trip " Romance of the Colorado River" by Frederick S. Dellenbaugh. The photographs contained in said book are correct reproductions of what I saw. 34 Said book was marked " Complainant's Exhibit No. 13" and 35 offered in evidence by complainant. Defendant objected to the proferred exhibit on the ground that it is hearsay and incompetent and also separately objected to all portions of the book relating to points outside the territory in controversy as irrelevant, ex-excluding only from the objection such photographs as disclose physical conditions or appearance of sections of the rivers in controversy and which can be identified by the witness. 37 - 38 " The Canyon Voyage", a narrative by Mr. Dellenbaugh of the second Powell expedition was offered in evidence as Exhibit No. 14 and objected to by defendant. 36 - 38 In the course of the discussion concerning defendant's - 5 - 1120 |
