Si par reconocimicntos que so practiqucn sc comprobarc Ia posibilidad y c01n-eniencia de coustruil' un camino, canal 6 fcrrocarril, que en toUo 6 en parte corra sabre e\ rio Gila 6 sobre alguna de sus margencs, dcrccha 6 izquicrda, en Ia latitlld de una legua marina de uno 6 dq otro !ado del rio, los gobicrnos de am bas B.cpUblicas se pondrfm de acucrdo sobrc su construecion, a fin clc que sirva igualmcntc para cl uso y provecho de ambos paiscs. ARTICULO VII. Como el rio Gila y Ia parte del Rio Brn.vo del Norte que corre bajo el lindP.ro meridional de Nuevo-Mexico1 se dividen par mitad entre las dos repO.blicaS, segun lo establecido en el articulo quinto; Ia navegacion en c1 Gila yen Ia parte qucqucda indi~ cada del Bravo, sera libre y comun 6. los buqucs y ciudadanos de ambos paises, sin que por alguno de elias pueda. hacerse (sin consentimiento del otro) ninguna obra que impida 6 intcrrumpa. en tot.lo 6 en parte el ejercicio de estc derecho, ni ann con motivo de favorecer nuevas mCtodos de navcgacion. Tampaco sc podrU cobrar (si no en el caso de desembarco en alguna de sus riberas) ningun impuesto 6 contribucion, bajo ninguna dcnominacion 6 titulo, a los buques, efectos, mercancias 6 personas que naveguen en dichos rios. Si para hacerlos 6 mantencrlos navegables, fuerc neccsario 6convenicnte cstableccr alguna contribucion 6 impuesto, no podni esto haccrse sin el consentimicnto lie los dos gobicrnos. Las estipulacioncs contenidas en el prescnte articulo, dejan ilesos los derechos territoriales de una y"otra RepUblica, dentro de los limitcs que les quedan marcados. ARTICULO Vlll. If, by the examinations which may be matlc, it should be ascertained to be practicable and ad·vantageous to construct a road, canal, or rail way which should in whole or in part run upon the river Gila, or upon its right or its left bank, within the space of one marine league from either margin of the river, the governments of both Republics will form an agreement regarding its construction, in order that it may serve equally for the use and advantage of both countries. ARTICLE VII. The river Gila, and the p11.rt of the Rio Bxavo del Nortr.lying below the southern boundary of New l\1exico, being, agreeably to the fifth article, divided in the middle betweeu the two Republics, the navigation of the Oila and of the Bravo below the said boundary to, hall be free and common to the vessels and citi· zens of both conntriesj and neither shall, without the consent of the other, construct any work that may impede or interrupt, itt whole or in part, the exercise of this right; not even for the purpose of favoring new methods of navigation, nor shall any tax or contribution under any denomination, or title, be Ia vied upon vessels or persons navigating the same, or upon merchandize or cttects transported thereon, except iu I he case of landing upon one of their shores. If, for the purpose of making the said rivers navigable, or for maintaining them in such state, it sltoulJ be necessary o.r advantageo~.;s to establish any tax or contribution, this shall not be done without the consent of both governments. The stipulations contained in the present article shall not impair the territorial rights of either Republic within its established limits. ARTICLE VJJJ.
