Show 883 He would differ a little bit from his brother, if he understood his testimony correctly; he believes that the houses were located about six or seven feet above the high water mark, and estimates the high water mark by the signs on rocks, and the high water that he saw when he first arrived there. He was not there either in 1909 or 1911; and 1915 was the next time he was there. When he first went in in 1902, and occupied the houses, there were no signs that they had ever been flooded prior to that time. When he saw them next they were covered up with sand and debris. R. 2087. He believes the entire river bed had been raised at least ten or fifteen feet. He doesn't know whether this was in 1911 or not, but it was during the time he saw it last, and up to the time he saw it the next time, between 1903 and 1915. R. 2087- 2088. Further Cross Examination.( R. Vol. 11., pp. R. 2088- 2091.) BY MR. FARNSWORTH: " Q. The river was still there, wasn't it? " A. Yes, but the bed wasn't. " Q. The sand had piled over on these houses? " A. Yes. " Q. When you first saw these houses in 1902 they had the appearance of being old structures at that time, didn't they? " A. Yes; they were in good condition; I don't know how long they had been there; put there by some of the former owners, I suppose." R. 2088. |
