Show 4 1 usefulness upon the continuation of the lease, and if it shall do 2 so shall pay to the lessee its net investment in the property 3 taken, not exceeding the fair value thereof at the time it is 4 so taken, with reasonable severance damages to property of 5 the lessee not taken. Such net investment or fair value and 6 damages, if not agreed upon, shall he fixed by a proceeding 7 in equity in the district court of the United States in the dis- 8 trict in which property, or some part thereof, is situated. 9 If the United States does not exercise its right to take over 10 such property, the Secretary of the Interior may renew the 11 said lease for not more than fifty years, or in his discretion 12 may make a lease under the terms hereof to a new lessee, 13 upon the condition that such new lessee shall pay to the 14 former lessee such net investment and damages determined 15 as aforesaid. If such property is not taken over by the 16 United States, or such new lessee, or such lease renewed, the 17 said Secretary shall extend such lease from year to year until 18 such property is so taken over or such lease renewed. 19 Compensation for leases, renewals, extensions, and new 20 leases shall be fixed with a view to the United States receiv- 21 ing such payments and revenue therefrom, as, with the 22 payments and revenue from rights disposed of under section 23 4 hereof, will cover all expenses of operating and maintain- 24 ing the said dam and incidental works and in addition thereto 25 reimburse the United States for the entire cost of such dam |
