PRWUA is advised that PROSIM is limited to simulating monthly averages, and as such, will be of little value to PRWUA in its accounting of the waters stored in Deer Creek Reservoir and/ or PRWUA's decisions as to the quantities and timing of its diversions from the Webef'River and/ or North Fork of the Duchesne River. 1. Paragraph 10( a) of the Operating Agreement provides that the allocations provided for in paragraph 9 shall be made as the Provo River natural flow waters are stored in Deer Creek Reservoir and/ or Jordanelle Reservoir, and a running accounting of the waters stored, allocated and exchanged will be maintained by the Utah State Engineer. In addition, a final allocation between PRWUA and CUWCD of the waters so stored will be made on the Final Allocation Date as provided therein. 2. Paragraph 11 of the Operating Agreement covering the Deer Creek/ Jordanelle exchange of import water provides that the Bonneville Unit water so stored in Deer Creek Reservoir will be credited to PRWUA as PRP water concurrently with the storage in Jordanelle Reservoir of like quantities of PRP water diverted from the Weber River drainage and/ or North Fork of the Duchesne River drainage. 3. Paragraph 20( a) of the Operating Agreement provides that the Utah State Engineer will maintain an accounting of the water diverted, stored, exchanged and released under the PRP water rights and BU water rights pursuant to this Operating Agreement, with updates of the accounting to be furnished to the parties at least weekly in paper or electronic form. Paragraph 20( b) provides for real- time measuring devices to provide the instantaneous measurements of necessary stream flows and reservoir elevations to the Utah State Engineer for the purpose of distributing and accounting of water under this Operating Agreement. In view of the above, PRWUA has serious doubts about the usefulness of PROSIM or whether it can achieve its study objectives and purposes. In any event, the PROSIM Draft Repon should clearly spell out its limitations relative to the Operating Agreement, June sucker flows and monthly averages. |
