Admitted: July 5, 1957 Agreement This Agreement, made and entered into this 28th day of December, 1943, by and between The Metropolitan Water District of Southern California, a public and municipal corporation of the State of California, hereinafter referred to as the "District," The City of Los Angeles, a municipal corporation of the State of California, hereinafter referred to as the "City," and the Department of Water and Power of the City of Los Angeles, a department of said city, hereinafter referred to as the "Department," Witnesseth: That Whereas, the parties hereto are parties to an agreement dated May 7, 1935, wherein, among other things, the District agreed to pay to the Department, under certain conditions fully set out in Article III of said contract, 36/50.9054 of the sum of Fifty-five Thousand Dollars ($55,000.00), or such portion thereof as shall not be recovered by, or paid to, the Department, from or by the United States, together with interest thereon at the rate of 4.56 per cent per annum from July 1, 1922, until date of payment; and Whereas, a controversy has arisen between the parties as to the interpretation of said article of said contract, and liability of the District thereunder, which controversy, if not made the subject of compromise, would result in litigation; and |
