-21- claim shall be prosecuted to final decision by the appropriate court of last resort, save and except the United States Supreme Court, unless the same shall have been sooner approved and paid. Article IV. In the event that the transfer and conveyance to the District of the real property, together with the water rights appurtenant thereto, or connected therewith, described in paragraph 1 of Article I of this agreement are not assented to by vote of two-thirds (}$) of the qualified voters of the City of Los Angeles voting on the proposition of such transfer and assignment, at a general or special election at which such proposition lawfully shall have been submitted on or before July 1, 1935, then the Department and the City shall be relieved of all obligation to transfer said real property and appurtenant water rights, and the one installment hereinbefore specified to be due, on or before October 1, 1935, shall be reduced by the sum of Seven Thousand Four Hundred Sixty-eight and 85/100 Dollars ($7,-468.85), but no other reductions in payment shall be made, nor shall this agreement be otherwise affected than as in this Article IV provided, by reason of the inability of the Department and the City to transfer and convey to the District the said real property and appurtenant water rights, as provided in said paragraph 1 of Article I of this agreement.
