The Special Master. Well, it is like so many other ques-tions in law, as to how far you can go. A reasonable distance beyond the locus undoubtedly has some bearing upon the ques-tion of navigability of the locus. But what bearing the condi-tion of this river in Colorado has upon conditions which we are now considering, I cannot see. I should not, of course, rule that you could not show conditions beyond the precise mileage that the suit is concerned with; and it seems to me that it depends upon whether there is any natural relation between the two. Now, how do the conditions of the river in Grand Junction affect the conditions on this river from Moab to Lees Ferry? We have in evidence the amount of water that reached Moab, and Castle Creek, and we have the conditions a reasonable distance north of Castle Creek; so that, as to the physical conditions of the river, we have ample testimony. Now, as to whether there is commerce on the river, or whether a boat can or cannot physically naviagate the river, |
