Show 5990 to any issue in this case. Mr. Blackmar. I do not think even an admission on Mr. Farnsworth's part would put into the record what I desire to have there. What I want is, at some place in this record, to show the conditions of this river in Colorado. In other words, when I get to the Supreme Court with this case, I do not want to be confronted by any question about what is the condition in Colorado, and not be able to point to the record and say what it is there. Mr. Farnsworth. Well, we object to this question very seriously, and counsel has not suggested any reason that ap-peals to me as being at all sound for its introduction. I object to it an irrelevant and entirely without the issues in this case, and as going into a subject matter that will be of no aid to the Court, And we think this is especially true, in view of the state of the pleadings with reference to interstate commerce on the Colorado and the Green. And I want to say here and now that we are not prepared to meet any evidence that may be offered on this subject by counsel. The Special Master. Well, that has no bearing, Mr. Farnsworth; because If I am wrong and the evidence is rele-vant, you take the risk of not answering relevant evidence |
