Show property taken and for damages. All expenses are paid from state funds. The superintendent is specifically authorized to " acquire immediately any property which is in the bed or beds of any streams, lakes- or rights- of- way" for flood control purposes. New Mexico Flood control commission in each county. Right of entry on private lands. No liability unless wanton or malicious damage. See Title 15, Chapter 50, New Mexico Statutes 1953. Nebraska See Sections 23- 308 to 320.7, Revised Statutes of Nebraska 1943. Power granted to counties, upon petition of freeholders, to construct levees, dikes, bank protection and current control; and maintain the same. Paid for by ratable assessment on basis of benefit. Also, there is provision made to allow cities and counties to cooperate with the federal government, to indemnify the federal government against loss during the construction of flood control projects under its supervision, and to allow the counties or cities to enter into agreements to take over and operate such projects. Oklahoma Title 82, Chapter 5, Oklahoma Statutes Annotated, authorizes the organization by the district court of conservancy districts for the purpose of preventing floods, regulating the flow of streams, regulating stream channels and as an incident to such purposes to straighten, widen, deepen and change channels of natural and artificial water courses. Oregon See Title 124, Oregon Compiled Laws, for a very comprehensive law pertaining to flood control districts. Pennsylvania Flood control authority is vested in Department of Forest and Waters, Purdons Penn. St. 71- 464,465. It has power to issue bulletins during freshet and flood conditions and construct, maintain, and operate works for flood control. It is also authorized to cooperate with municipalities in construction, maintenance and operation of flood control works and the control of floods. Texas Article 7880, Vernon's Texas Civil Statutes, authorizes the organization of " Water Control and Improvement Districts" for the improvement of rivers, creeks and streams to prevent overflows. The Attorney General of Texas has ruled that such districts have the power to construct and maintain levies and flood control projects. Section 59, Article 16 of the Constitution, permits " Water Control and Improvement Districts" to control flood waters. Districts are given the power to issue bonds and to levy taxes to pay for improvements and control of water. Levee Improvement Districts- Article 7972. - 35- |
