Show Iowa Chapter 467C. 2, Code of Iowa 1950, gives to the board of supervisors of the counties the power to establish districts for flood control and to cause to be constructed such improvements and facilities as are essential. Financed through assessment on those benefited. Idaho Sections 42- 3101 to 3142, Idaho Code, provide that upon petition to the state reclamation engineer signed by the owners of one- third of the property involved and after hearing flood commissioners may be appointed by the state reclamation engineer. Any project is financed through assessment of the lands benefited. Kentucky State flood control and water usage board authorized. See sections 104.390 Baldwins Kentucky Revised Statutes Annotated, et seq., board given emergency powers 104.410. Ma ssachusett s Flood control is under state planning board. Chapter 6, Sec. 50, Annotated Laws of Massachusetts. Minnesota 112.01 et seq. Mason's Minnesota Statutes. Upon petition signed by 25 freeholders, and hearing, the district court has jurisdiction to establish flood control and drainage districts. Districts are legal bodies corporate and are governed by a board of directors of 3 to 5 appointed by the court. Districts have the power of condemnation and may construct improvements with court approval. Districts financed by those benefited. Collection made by county officials. Mississippi Comprehensive flood control act. See Mississippi Code 1942, Sections 4763 et seq. Montana Nothing on flood control as such. Sections 82- 2601 to 2605, Revised Code of Montana 1947, provide for disaster relief. In the event of a disaster ( includes floods) proclaimed by the governor, a council directs state disaster relief, makes plans, and advises the governor. New York The comprehensive New York flood control statute, Unconsolidated Laws, Sections 1301- 1307 authorizes the Superintendent of Public Works to acquire by appropriation " any property, or interest therein, necessary for purposes connected with flood control projects." A simplified procedure in the nature of condemnation is instituted against landowners with broad authority in the Superintendent to make settlements and adjustments. If no settlement can be made the landowner may file a suit in the court of claims for the value of - 34- |
