Show APPENDIX A AN ACT AMENDING TITLE 73, UTAH CODE ANNOTATED 1953, BY ADDING THERETO A NEW CHAPTER TO BE KNOWN AS CHAPTER 18, TO PROVIDE FOR FLOOD CONTROL. Be it enacted by the Legislature of the State of Utah: Section 1. The State Engineer of Utah is hereby designated ex officio flood control commissioner for the State of Utah and he is authorized to represent the State of Utah in all matters pertaining to flood control. He is directed to study causes of floods and methods of preventing and minimizing floods and flood damage and in connection therewith it shall be his duty to cooperate with counties, cities, state agencies, federal agencies, waters users on the river systems, and others, for the study of flood control, and to coordinate the activities of all state departments and agencies concerned with the problems of flood control,, Section 2. In times of extraordinary stress and disaster resulting from storms and floods, or the threat thereof, and, upon the recommendation of the flood control commissioner, the governor shall declare by public proclamation the existence of an emergency if in his opinion the emergency is a matter of general public and state concern. During an emergency the commissioner may take such measures as are required to save lives or to avert or alleviate damage to, or destruction of, property, or to repair or restore property damaged or destroyed by floods, including, but not limited to, ( a) construction of dikes, levies, and temporary channels and roads, ( b) clearing natural and artificial channels, and ( c) taking emergency custody and control of rivers and streams, and of reservoirs, canals and other works on any river or stream which is in flood, or on which a flood is threatened, and operating such works to avert or minimize flood damage; provided that the commissioner shall consult with the owners and operators of such works before using them for flood control purposes. - 30- |
