Show 545 In all probability if he had been familiar with the channel he would have avoided a great deal of that trouble. It was his opinion then, and always has been, that the trouble that they had in going down stream and in coming up stream was due to shifting sands; " the channel was deeper coming up stream." He made no notes. R. 1334. So far as he remembers he did not get struck in any place coming up stream, where he had had no trouble going down stream. There were three or four places where he had had trouble coming down stream, but where he had no trouble coming up stream. R. 1334. " Q If you had had trouble at those three or four places going down stream, why did you tackle the came places coming up stream? " A That I can't remember. I suppose -- you know, the water flows quite swift to certain places, the boat doesn't always obey the rudder, and in all probability we were carried in there by the shifting current." R. 1334- 1335. While he has no recollection of the specific places there probably were places where he had encountered no difficulty going down stream, where at he encountered difficulty coming up stream.
