Pages were scanned at 400 ppi on Fujitsu fi-5650C sheetfed scanner as 8-bit grayscale or 24-bit RGB uncompressed TIFF images. For ContentDM access the images were resampled to 750 pixels wide and 120 dpi and saved as JPEG (level 8) in PhotoShop CS with Unsharp Mask of 100/.3. Foldout pages larger than 11" x 14" were captured using a BetterLight Super 8K-2 digital camera back on a 4x5 view camera (100mm Schneider APO lens). Oversize images were resampled to 1500 pixels wide. Optical Character Recognition (OCR) by ABBYY FineReader 7.0 with manual review. |

Show used to supply "perfected rights" in other States in the event of a shortage. Nevada proposed that there be a floor placed on her allocation below which the Secretary could not go even in times of shortage. In other words Nevada claimed a right to a fixed amount which would not be subjected to diminution by reason of "perfected rights" claims in the other States. Nevada also objected to the failure of the Master to provide for a Commissioner to supervise the operation of the decree. Nevada wanted this Commissioner to be given power to promulgate rules and regulations setting forth the method of operation under the decree. Nevada finally reserved the right to argue her legal theories for the settlement of the dispute between the parties, even though she did not specially object to the basic theory of the Special Master. New Mexico did not file specific objections to the Special Master's Report. It was pointed out in New Mexico's "Exceptions" that she felt that the "Reservation Theory" was not the most efficient method of developing water resources in the west; however, New Mexico did not object to its application in this case. New Mexico further noted that in one area of the Gila River Basin that Arizona apparently was not controlling her underground water development, and if such development continued, New Mexico would request the court to control Arizona in order to protect New Mexico's decreed rights. Utah did not file any exceptions to the Special Master's Report. Subsequent to the filing of the exceptions Arizona, California, Nevada and the United States filed briefs to support their exceptions. This case will be ready for argument before the Supreme Court sometime after October 2, 1961, the final date for filing briefs. Marble Canyon - Bridge Canyon In order to protect the rights of the Upper Basin to an unhampered operation of Glen Canyon Dam and Reservoir, the Upper Colorado River Commission filed a petition of intervention in the applications of the Arizona Power Authority and City of Los Angeles before the Federal Power Commission. The Arizona Power Authority has applied for a license to construct both Marble Canyon and Bridge Canyon Dams. The City of Los Angeles' application was for construction of Bridge Canyon Dam only. In the Twelfth Annual Report it was stated that based upon certain actions by Arizona it would be ".. . possible for the Upper Colorado River Commission to withdraw as an active participant in 34 |
