Pages were scanned at 400 ppi on Fujitsu fi-5650C sheetfed scanner as 8-bit grayscale or 24-bit RGB uncompressed TIFF images. For ContentDM access the images were resampled to 750 pixels wide and 120 dpi and saved as JPEG (level 8) in PhotoShop CS with Unsharp Mask of 100/.3. Foldout pages larger than 11" x 14" were captured using a BetterLight Super 8K-2 digital camera back on a 4x5 view camera (100mm Schneider APO lens). Oversize images were resampled to 1500 pixels wide. Optical Character Recognition (OCR) by ABBYY FineReader 7.0 with manual review. |

Show 1. To the Master's refusal to find that Section 4 (a) of the Project Act provided a mandatory formula for the allocation of water which the Secretary was required to follow. Arizona had taken the position that Section 4 (a) provided a mandatory formula. 2. To the Master's finding and conclusion that under the provisions of Arizona's Water Delivery Contract, Arizona is bound to recognize rights in Nevada, Utah and New Mexico. Arizona claims that these provisions are beyond the mandatory formula and also that they violate Section 5 of the Project Act that requires that the contracts be for permanent service, and also that the provisions introduce tributary considerations into the main stream apportionment. Arizona attacked the Master's findings and conclusions with respect to the United States' main stream claims as follows: 1. The Master's findings that there is no need for a contract for each Indian Reservation. Arizona states this is contrary to Section 5 of the Boulder Canyon Project Act. 2. The findings and conclusions that the United States impliedly intended to reserve main stream water for the future needs of the main stream reservations in an amount sufficient to irrigate all irrigable acreage on such reservations irrespective of the number of Indians living on the reservations. 3. The findings and conclusions that the Indian water rights are of a fixed magnitude and priority-appurtenant to defined land, and subject to use, regardless of the user, and may be used or disposed of by the United States for the Indian's benefit under relevant law. 4. Arizona objected specifically to the rights of each specific reservation. Arizona's objection is based upon the following claims: 1. The Winters case 207 U.S. 564 (1908) applied to a non-navigable stream, and the Master should have examined the source of the power of United States to reserve water from a navigable stream; and if he had, he would have found that a clear intent to make such reservation must be manifested, and an inference of such 28 |
