Dietrich, District Judge: From the pleadings and stipulation of facts upon which the cause is submitted, it appears that the United States is the guardian for certain Indian wards, of lands, allotted to them upon what was formerly a part of the Fort Hall Indian Reservation, the lands lying along the Portneuf River, near Inkom, in Bannock County, Idaho, at a point where Indian Creek empties into the river. There are seven allotments of eighty acres each, being numbered respectively from 11 to 17 inclusive, No. 11 being to Tindore, No. 12 to Mogozah, No. 13 to Robert Tindore, No. 14 to Hevedore Tindore, No. 15 to Fee-Emb, now deceased, No. 16 to Pattish, and No. 17 to Tsaco-robe, now deceased. The plaintiff Hofhine is the lessee |
