OCR Text 129 CHAPTER II 51AN ACT in relation to Justices of the Peace Sec Be it enacted by the Governor Legiss lative Assembly of the Territory of Utsh That hJ Precinct in this Territory shall elect one Jusfice of the In esdistror Peace and one Constable and the same1y be increasedin any Precinct by the County court whenever they shall deem that the public good requires it Sec Each Justice of the Peace shall take an oath of office and give bond with approved secarities in the egr sum of one thousand dollars which bond shall be approved by the County court and filed in the clerkToace office said Justices and Constables shall hold their oftwo years tices for the term of two years and until their successors are elected and qualified and they shall be comComnissioned missioned by the Governor bythe Gov Sec Tt shall be the duty of every Justice of the Peace to examine strictly and faithfully into the merits Dutios of and demerits of all civil and criminal cases which may Joc come before him and execute justice without Tespect to persons or favor or the technicalities of the or the the law pre serve the public peace sit in judgment in all cases referred to him and keeptrue record of all proceedings Jaid before him and in case of appeal transmitcopy of the same to the Clerk of the Court to which the appeal is made within five days from the time the appeal is taken Sec Justices of the Peace have jurisdiction over all cases where the amount in controversy does not exJudiniedon foc eed one hundred dollars and when the amount claim ed exceeds that sum but by fair credits may be reduced to that amount justices may decide cases without pro eess but if it shall become necessaryto enforce peace such decisions they shall enter such cases so decided upon their dockets and proceed as in other cases Justices of the Peace in their respective counties have jurisdiction of and may try hear and determine public offen ces where the punishment imposed by law does not exceed one hundred dollars fine or imprisonment does not exceed six months or when both such fine and imprisonment the punishment is by Oriminal ne eSec Criminal actions for the commissi1on of pubthns encemayd belic offences may be commenced beforeJustice of the comm grox justice Digital image 2005 J Quinney College of Law Al rights reserved
