I will state there was; there was changes all the time, one place to another. " Q. What was it changed from one place to another? What was it you say changed from one place to another all the time? " A. The channel, what you call the channel. R. 752. " Q. But you admitted testifying on direct examination, and you still say that you can not tell whether the channel had changed at any particular place in the river between those two trips? " A. Not in general, I couldn't; so many of them, you couldn't keep track of them; I couldn't do it, nobody else, " Q. If there were a thousand curves on that river, let's say, or on a certain portion of that river, when you go along those thousand curves that look so much alike, how can you tell whether, as to any one of them; there has been a change since a former trip? " A. You can tell when you hit it, when you come along down there and try the same place and get stuck, and had been down there before, there must have been a change. " Q. How could you tell it was the same place? " A. I did remember some of it at that time, those places, when I was there. " Q. Then it wasn't difficult for you to tell the channel had changed at a particular place. " A. Yes, it was difficult." R. 752- 753. |
